This privacy policy explains how I comply with the EU’s GDPR (General Data Protection Regulation) legislation and the DPA (Data Protection Act).

It explains how your privacy and personal details are collected and managed and how I process, collect, manage and store those details and how your rights under the GDPR and DPA are adhered to.

This website complies with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation), effective from May 2018.

CONTACTING US

www.danwaterscreative.com collects private user data using a selection of sign up forms throughout the website and an enquiry form (on the contact page.

The data you enter through the enquiry form and the sign up forms is emailed to my email address dan@danwaterscreative.com.

If you fill out one of the sign up forms on the website then the details you enter will also stored on my email newsletter management supplier: www.aweber.com. You will then be sent email newsletters periodically. The sign up forms have a message stating this fact underneath them in bold type.

By completing my contact forms you agree to Dan Waters Creative contacting you about his photography services using the contact details you have supplied.

Your personal details will not be passed onto any third parties unless is specifically says so underneath the sign up form.

Any enquiry you send me and any response from me will be stored in my business email system managed by www.rackspace.com

 If you wish to have these emails deleted please email dan@danwaterscreative.com

CLIENT DATA HELD ON FILE

To ensure I can provide the best possible service to my clients I store any personal data you give me, including (but not limited to) 

1. Names

2. Contact details

3. What you ordered

4. How much you spent

If you decide to book my photography services your details and photographs are held within soft copy only (not hard copy). Soft copy details are safely stored within my password protected iMac, and backed up to two external hard drives.

 

CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS

Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Dan Waters Creative will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by Dan Waters Creative as a part of the visual recording of the event. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Dan Waters Creative as detailed in this privacy policy.

In terms of explicit GDPR compliance, Wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Dan Waters Creative as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests.

Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding guests are therefore required to ask me either in advance of the wedding or on the wedding day if they are not happy with anything within this policy.

 

WITHDRAWL OF CONSENT

Anyone photographed by Dan Waters Creative may withdraw consent for a photograph in which they appear to be displayed. The process for this is to email dan@danwaterscreative.com specifying the photo in question. Dan Waters Creative will then remove the photograph from this website, from my social media, from my backup systems and any printed media within 30 days of request.

 

SOCIAL MEDIA POLICY & USAGE

We adopt a safe and responsible Social Media Policy. While we may have official profiles on social media platforms, users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.
